N\u2019est-ce pas une contradiction qu\u2019une exemption nationale soit \u00e0 nouveau test\u00e9e au niveau provincial&nbsp;?[\/vc_column_text][divider line_type=\u00a0\u00bbNo Line\u00a0\u00bb custom_height=\u00a0\u00bb25&Prime;][vc_column_text]\n<h2><u>Le verdict et les cons\u00e9quences<\/u><\/h2>\n[\/vc_column_text][divider line_type=\u00a0\u00bbNo Line\u00a0\u00bb custom_height=\u00a0\u00bb25&Prime;][vc_column_text]Le tribunal s\u2019est prononc\u00e9 sur la d\u00e9cision de l\u2019ex\u00e9cutif provincial de Gueldre d\u2019approuver le \u00ab Plan de gestion de la faune pour la chasse et la mise en \u0153uvre de l\u2019exemption 2017-2023 \u00bb (ci-apr\u00e8s : le \u00ab Plan de gestion de la faune \u00bb). Le tribunal a examin\u00e9, entre autres, ce qui suit :[\/vc_column_text][divider line_type=\u00a0\u00bbNo Line\u00a0\u00bb custom_height=\u00a0\u00bb25&Prime;][vc_column_text]\u00ab <em>(&#8230;) 4.4 Cela signifie que le d\u00e9fendeur (lire : la province) doit \u00e9valuer si les conditions d\u2019exemption de la Wnb ont \u00e9t\u00e9 respect\u00e9es lors de l\u2019approbation du plan de gestion de la faune. L\u2019une des conditions pour exempter les esp\u00e8ces vis\u00e9es \u00e0 l\u2019article 3:1, paragraphe 1, et \u00e0 l\u2019article 3:10, paragraphe 1, de l\u2019interdiction de l\u2019abattage intentionnel sur le fondement de l\u2019article 3.15 du Wnb est que ces esp\u00e8ces causent des dommages. En outre, les conditions doivent \u00eatre remplies, entre autres, qu\u2019il n\u2019existe pas d\u2019autre solution satisfaisante, que la d\u00e9rogation soit justifi\u00e9e sur la base de l\u2019un des int\u00e9r\u00eats vis\u00e9s par les dispositions en cause et qu\u2019il n\u2019y ait pas de d\u00e9t\u00e9rioration de l\u2019\u00e9tat de conservation.<\/em><\/p>\n<p><em>Sur la base de ces conditions, le d\u00e9fendeur doit \u00e9valuer si l\u2019exemption nationale et provinciale peut \u00eatre mise en \u0153uvre dans la zone d\u2019activit\u00e9 de l\u2019unit\u00e9 de gestion de la faune, qui, \u00e0 l\u2019exception du domaine de la Couronne Het<\/em><em> Loo,<\/em><em> comprend l\u2019ensemble de la province de Gueldre.<\/em><\/p>\n<p><em>4.5. Le tribunal constate que la d\u00e9cision attaqu\u00e9e n\u2019\u00e9value pas que les esp\u00e8ces vis\u00e9es au point 3.2 du pr\u00e9sent arr\u00eat causent des dommages dans l\u2019ensemble du pays, ou plus pr\u00e9cis\u00e9ment dans la province de Gueldre, quelle est l\u2019\u00e9tendue de ces dommages et que ces dommages ne peuvent \u00eatre \u00e9vit\u00e9s d\u2019une autre mani\u00e8re en tuant l\u2019esp\u00e8ce. L\u2019ordonnance sur l\u2019environnement, le plan de gestion de la faune ou le m\u00e9moire en d\u00e9fense ne contiennent pas non plus de tels justificatifs.
