Surtout maintenant avec les proc\u00e9dures en cours de Vogelbescherming Vlaanderen. <\/p>\n<p>Le 8 ao\u00fbt 2014, Vogelbescherming a d\u00e9pos\u00e9 une p\u00e9tition contre le gouvernement flamand pour obtenir la nullit\u00e9 et non avenue d\u2019un certain nombre de dispositions des arr\u00eat\u00e9s de chasse de ce gouvernement flamand.<br \/>\n\u2013 La p\u00e9tition compl\u00e8te de 2014 \u2013 <a title=\"P\u00e9tition Vogelbescherming Vlaanderen\" href=\"https:\/\/hunting.be\/wp-content\/uploads\/2020\/02\/Verzoekschrift-Vogelbescherming-Vlaanderen.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">P\u00e9tition Vogelbescherming Vlaanderen<\/a><\/p>\n<p>Et qu\u2019apprenons-nous de cela :<\/p>\n<p>Les plus gros probl\u00e8mes qu\u2019ils rencontrent avec la r\u00e9glementation actuelle en mati\u00e8re de chasse sont dans le domaine de la chasse dans la neige et le gel, la chasse sp\u00e9ciale du renard, l\u2019utilisation d\u2019app\u00e2ts dans les pi\u00e8ges \u00e0 bo\u00eetes, la chasse sp\u00e9ciale en g\u00e9n\u00e9ral en raison de l\u2019absence de base l\u00e9gale, la chasse sp\u00e9ciale des esp\u00e8ces d\u2019oiseaux parce qu\u2019elle est contraire \u00e0 la directive europ\u00e9enne sur les oiseaux, etc.  La chasse \u00e0 la perdrix, la chasse au renard, l\u2019utilisation du carrousel \u00e0 pigeons, l\u2019\u00e9closion et la r\u00e9introduction des couv\u00e9es de faisans et l\u2019expansion de la chasse hivernale des oies cendr\u00e9es et des canards siffl\u00e9s.<\/p>\n<p>Dans la derni\u00e8re p\u00e9tition qu\u2019il a adress\u00e9e au Conseil d\u2019\u00c9tat, Vogelbescherming Vlaanderen a soulev\u00e9 8 moyens qui sont expos\u00e9s ci-dessous.<\/p>\n<h4>1. Il ne reste plus qu\u2019\u00e0 attendre une modification de l\u2019arr\u00eat\u00e9 d\u2019ouverture de la chasse qui pr\u00e9voit de nouvelles dates d\u2019ouverture pour la chasse sp\u00e9ciale. <\/p>\n<h4>2. Le sch\u00e9ma Neige et givre<\/h4>\n<p>La prochaine r\u00e9glementation que Vogelbescherming Vlaanderen souhaite voir annul\u00e9e est la r\u00e9glementation de la chasse en cas de neige ou de gel. Ce r\u00e8glement figure actuellement \u00e0 l\u2019article 7 du d\u00e9cret sur les conditions de chasse et se lit comme suit : <\/p>\n<p><em>\u201c\u00a7 1. S\u2019il neige \u00e0 l\u2019endroit o\u00f9 se d\u00e9roule la chasse et que la couche de neige atteint une \u00e9paisseur de cinq centim\u00e8tres, la chasse est suspendue. La suspension dure jusqu\u2019\u00e0 24 heures apr\u00e8s la derni\u00e8re chute de neige. La suspension vis\u00e9e au premier alin\u00e9a ne s\u2019applique pas dans les cas suivants&nbsp;:   <\/em><\/p>\n<ul>\n<li><em>1\u00b0 pour la chasse dans les bois et le gibier qui est pouss\u00e9 hors de ces bois et \u00e9tendu en plein champ, dans un rayon de 50 m\u00e8tres des for\u00eats pr\u00e9cit\u00e9es ;<\/em><\/li>\n<li><em>2\u00b0 pour la chasse au pigeon ramier, \u00e0 la bernache du Canada et au lapin ;<\/em><\/li>\n<li><em>3\u00b0 pour la chasse aux oiseaux d\u2019eau sur ou imm\u00e9diatement le long des marais, \u00e9tangs et cours d\u2019eau, dans le respect de l\u2019alin\u00e9a 2\u00b0 du pr\u00e9sent article&nbsp;;<\/em><\/li>\n<li><em>4\u00b0 pour la chasse au gros gibier.<\/em><\/li>\n<\/ul>\n<p><em>\u00a7 2. La chasse \u00e0 la sauvagine est interdite \u00e0 une distance de 150 m\u00e8tres ou moins le long des marais, des \u00e9tangs et des cours d\u2019eau dont plus de la moiti\u00e9 de la surface et des roseli\u00e8res associ\u00e9es le long des berges sont recouvertes de glace. <\/em><br \/>\n<em>\u00a7 3. En cas de gel\u00e9es tr\u00e8s dures et prolong\u00e9es, la chasse peut \u00eatre temporairement suspendue par le chef de l\u2019agence. La suspension de la chasse peut \u00eatre impos\u00e9e par province et par cat\u00e9gorie de gibier. Le chef de l\u2019agence prend la d\u00e9cision de suspendre la chasse sur avis du directeur provincial comp\u00e9tent de l\u2019agence.   <\/em><\/p>\n<p>Il existe actuellement un avis de l\u2019auditeur du Conseil d\u2019\u00c9tat qui soutient la vision de Vogelbescherming Vlaanderen. Le jugement sur cette question est attendu \u00e0 la fin de cette ann\u00e9e. <\/p>\n<h4>3. Utilisation d\u2019app\u00e2ts v\u00e9g\u00e9taux et d\u2019app\u00e2ts pour animaux non vivants<\/h4>\n<p>Le prochain moyen que Vogelbescherming Vlaanderen \u00e9l\u00e8ve est l\u2019utilisation d\u2019app\u00e2ts v\u00e9g\u00e9taux et d\u2019animaux non vivants. La Soci\u00e9t\u00e9 n\u00e9erlandaise pour la protection des oiseaux veut que cela soit d\u00e9truit. Actuellement, l\u2019article 13 de l\u2019arr\u00eat\u00e9 sur les conditions de chasse le permet et se lit comme suit :  <\/p>\n<p><em>Pour la chasse ou le contr\u00f4le avec des pi\u00e8ges \u00e0 bo\u00eete ou des pi\u00e8ges \u00e0 cage, des app\u00e2ts pour plantes et animaux non vivants peuvent \u00eatre utilis\u00e9s comme leurre.<\/em><\/p>\n<p>Le Conseil d\u2019\u00c9tat ne s\u2019est pas encore prononc\u00e9 \u00e0 ce sujet.<\/p>\n<h4>4. La chasse nocturne<\/h4>\n<p>\u00c9tant donn\u00e9 que les sangliers sont des animaux nocturnes, le d\u00e9cret sur les conditions de chasse pr\u00e9voyait la chasse sp\u00e9ciale de cette esp\u00e8ce \u00e9galement la nuit \u00e0 l\u2019aide de la lumi\u00e8re artificielle. La Soci\u00e9t\u00e9 pour la protection des oiseaux fait valoir que l\u2019utilisation de ces produits est contraire aux dispositions du Benelux et aux articles 6 et 19 du d\u00e9cret sur la chasse. La r\u00e9glementation relative \u00e0 la chasse nocturne et \u00e0 l\u2019utilisation de la lumi\u00e8re artificielle \u00e9tait pr\u00e9vue aux articles 9 et 33 ainsi qu\u2019au d\u00e9cret sur les conditions de chasse.  <\/p>\n<p>Dans ce domaine \u00e9galement, l\u2019auditeur s\u2019est prononc\u00e9 en faveur de l\u2019avis de Vogelbescherming Vlaanderen. Il n\u2019y a pas encore de jugement final du Conseil d\u2019\u00c9tat au complet, mais il suivra probablement \u00e0 la fin de cette ann\u00e9e. <\/p>\n<h4>6. L\u2019utilisation du carrousel \u00e0 pigeons<\/h4>\n<p>Les articles 39 et 51 du d\u00e9cret sur les conditions de chasse autorisent \u00e0 nouveau l\u2019utilisation du carrousel \u00e0 pigeons dans le cas d\u2019une chasse et d\u2019un contr\u00f4le sp\u00e9ciaux. Reproduction des couv\u00e9es de faisans<\/h4>\n<p>Enfin, la Soci\u00e9t\u00e9 de protection des oiseaux demande l\u2019annulation de l\u2019article 65 de l\u2019arr\u00eat\u00e9 sur les conditions de chasse, qui se lit comme suit :<\/p>\n<p><em>S\u2019il n\u2019y a pas d\u2019autre solution satisfaisante pour prot\u00e9ger les nids de faisans des menaces du travail agricole, les \u0153ufs de ces couv\u00e9es peuvent \u00eatre transf\u00e9r\u00e9s pour l\u2019\u00e9closion et l\u2019\u00e9levage des jeunes. La personne responsable de l\u2019incubation des \u0153ufs et de l\u2019\u00e9levage des jeunes notifie \u00e0 l\u2019Agence le nombre de nids, le nombre d\u2019\u0153ufs et le nombre de jeunes \u00e9lev\u00e9s au moyen d\u2019un formulaire de notification papier ou \u00e9lectronique dont le mod\u00e8le est \u00e9tabli par l\u2019Agence et disponible sur le site internet de l\u2019Agence www.natuurenbos.be. Le formulaire de notification est adress\u00e9 \u00e0 l\u2019Agence au plus tard le 1er juillet selon l\u2019un des modes suivants&nbsp;:<br \/>\n1\u00b0 par lettre recommand\u00e9e&nbsp;;<br \/>\n2\u00b0 par courrier \u00e9lectronique ;<br \/>\n3\u00b0 par voie \u00e9lectronique.  <\/em><\/p>\n<p><em>Au plus tard le 31 juillet de la m\u00eame ann\u00e9e civile, les jeunes \u00e9lev\u00e9s sont rel\u00e2ch\u00e9s dans la nature sur les m\u00eames terrains de chasse o\u00f9 les \u0153ufs ont \u00e9t\u00e9 collect\u00e9s.<\/em><\/p>\n<p>Selon Vogelbescherming Vlaanderen, cela garantit que les chasseurs disposent d\u2019une porte d\u00e9rob\u00e9e pour rel\u00e2cher les faisans et cette disposition est donc contraire \u00e0 la directive oiseaux, au d\u00e9cret sur la chasse et au principe de la diligence requise.<\/p>\n<p>L\u2019auditeur du Conseil d\u2019\u00c9tat les suit \u00e9galement dans ce domaine.<\/p>\n<p>Il va donc sans dire que les prochaines d\u00e9cisions du Conseil d\u2019\u00c9tat pourraient s\u00e9rieusement bouleverser le paysage de la chasse si l\u2019arr\u00eat du Conseil d\u2019\u00c9tat suit pleinement les moyens invoqu\u00e9s. Nous devons donc attendre et voir.
